The ninth circuit court has upheld a prohibition on deploying national guard in Portland, Oregon, after a recent legal decision.
The federal appeals court decided on this week that it would reexamine the case concerning the executive power with an expanded panel of eleven justices. The judicial body also overturned a earlier ruling from a smaller judicial group that had sided with the administration.
This order represents the most recent turn in a long-running legal battle over whether the former president has the authority and justification to deploy state military units in the city. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was initiated in due to months of protests.
The federal government has claimed that government employees at the immigration center in south Portland were under attack, while city and state officials maintain that local officers have control of the circumstances.
In defiance of descriptions of Portland as “war ravaged”, residents have been posting videos of scenic paths and a vibrant culinary culture, and organizing events such as an protest bicycle event against the “militarization of our city”.
The appeals court decision came after a federal judge in the city issued two legal injunctions this period – one blocking the federal control of the Oregon national guard, and another prohibiting the deployment of any national guard troops in Oregon, after efforts to circumvent the first order by mobilizing troops from California.
On the previous day, the ninth circuit panel had put the first ruling on hold – permitting command of state troops – but the subsequent injunction remained in place, blocking the actual deployment of the troops.
The Tuesday decision means the matter will be heard by the full court – with both rulings under review simultaneously – by a group of 11 judges.
“This decision demonstrates that facts are important and that the judicial system are striving to hold this administration accountable. The founding document limits the executive authority, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.
“The judicial body is sending a clear message: the executive leader cannot dispatch the military into US cities without cause. We will continue defending state legislation, values, and autonomy as this case progresses and our legal battle continues in the judicial system.”
